Welcome to the website careerkey.org (the "Site"). The related platforms, products, and services available on or from the Site are owned and operated by Career Key, Inc. (hereinafter referred to as "our", "we", "us", or "Career Key") and are herinafter referred to as the "Services."
Career Key cares about online privacy and wants you to know how we collect, use and share and protect information about you and the choices you have regarding our use of your information. If you have any questions concerning this Privacy Policy, please email us at support@careerkey.org. We may change or add to this Privacy Policy from time-to-time, so we encourage you to review it periodically.
SCOPE
This Privacy Policy applies to the collection of personal information from users of the Services. It relates to personal information we collect from you as described further in Information Collected and Used By Career Key below. This Privacy Policy is incorporated into and subject to our Terms and Conditions that apply to use of this Site. By using the Services and this Site, you consent to our General Terms and Conditions and Privacy Policy, including our use and disclosure of your personal information as stated in this Privacy Policy, whether or not you sign up for an account with us.
In some cases, we may collect, receive, or otherwise process personal information from or on behalf of our Institutional Customers, Business Customers, or Channel Partners in connection with services we provide to them. In those cases, our handling of that personal information is governed by our agreements with those customers. We are not responsible for the policies or practices of these customers with respect to the personal information they provide to us or otherwise collect, and we encourage you to review the privacy policies of any of our Channel Partners, Institutional or Business customers to whom you provide personal information understand how they collect and process your personal information.
Artificial Intelligence (AI) Input and Output Data. Career Key uses AI to process your Interactive User Content to deliver automated responses and improve service quality. Before any processing, personal information is filtered out; Career Key does not use Interactive User Content to train third-party AI models.
Institutional Accounts. For Institution-sponsored accounts, Career Key processes assessment results and Interactive User Content as part of the Institution’s education record, under the Institution’s direction. The Institution decides when to delete or export this information.
Direct to Consumer Accounts. If you are an Individual User, your Interactive User Content is retained under Career Key’s retention schedule and can be deleted upon request as described in Accessing or Removing Information.
INFORMATION COLLECTED AND USED BY CAREER KEY
At sign up, Career Key collects user submitted information such as name, mailing address, and email address. Career Key uses that information to authenticate users and to send notifications to users relating to, without limitation, the Services and other opportunities.
When you sign up for our Services, we collect information regarding your career interests, education interests, and decision making needs. We may use this information to provide you resources relevant to your career and education decision making.
When you complete our assessments, we collect your responses to the assessment questions and any other information you may choose to provide through the assessment platform. We use this information to provide your assessment results and related Services.
We may also ask you to complete a survey to gauge your satisfaction with the Services. If you choose to complete a survey, we will collect your responses to the survey and any other information you choose to provide through the survey. We use this information to develop, deliver, and improve our products, Services, and other offerings.
If you choose to make a purchase through the Services, we will request information necessary to process your payment, such as your payment card number, expiration date, security code, and billing address to process your purchase.
As is standard practice, Career Key also logs personal information, including IP address, profile information, aggregate user data, and browser type, that is automatically collected from the Site. In cases where you use a mobile device to access the Site and use the Services, we may automatically received information about the location of your device. This data is used to improve the Site services, to analyze trends, to administer the Site, to track users' movements around the Site and to gather demographic information about our user base as a whole. Career Key will not use the information collected to market directly to that user. User IP addresses are recorded for security and monitoring purposes.
In addition, Career Key uses pixel tags - tiny graphic images - to tell us what parts of the Site have been visited or to measure the effectiveness of searches users perform on the Site. Pixel tags also enable us to send email messages in a format that users can read. And they tell us whether emails have been opened to assure that we are only sending messages that are of interest to our users.
Career Key may also use a user's email address to send updates, a newsletter or news regarding the Services. Career Key may send email messages which use a "click-through URL" linked to content on the Site. When a user clicks one of these URLs, they pass through our web server before arriving at the destination web page. Career Key tracks this click-through data to help determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked simply avoid clicking text or graphic links in the email. Users who no longer wish to receive promotional messages or updates may choose not to by opting-out. To opt-out, click on "unsubscribe" from the email (if available) or reply with the word "unsubscribe" in the subject line of the email. You can also forward the email to support@careerkey.org with the same "unsubscribe" message. All notification emails and Career Key newsletters also include the above instructions for opting-out of those communications in the future. Note that users who have opted-out of promotional messages or updates may still receive email messages from Career Key where necessary to provide a Service you have requested or where necessary to inform you of critical information relating to your use of the Site.
We use the information that we collect to develop, deliver, and improve our products, Services, and other offerings. In cases where you use a mobile device to access the Site and use the Services, we may receive information about the location of your device. We may use this information to develop, deliver, and improve our products, Services, and other offerings.

In some cases, we may deidentify or aggregate the personal information we collect for any lawful purpose, including without limitation participating in research that evaluates user outcomes.
Educational Records and FERPA Compliance
When Career Key provides services to a higher education institution, certain student information—including assessment responses and Interactive User Content such as, “Other Factors” notes, and AI interactions—may constitute education records under the Family Educational Rights and Privacy Act (FERPA). In these cases:
Career Key acts as a school official with a legitimate educational interest in processing this information on behalf of the Institution.
Career Key does not use or disclose education records for any purpose other than providing contracted services to the Institution.
Institutions retain all rights to access, amend, and control retention of education records.
If a student later “claims” their account for personal use outside the Institution, becoming an Individual User, the Institution retains control over prior education-record data, and the individual controls subsequent data.
USE OF COOKIES
Career Key uses cookies to store users' preferences and to record session information, for purposes including: (i) to customize Site content based on browser type and user profile information; (ii) to help track usage to help us understand which parts of the Site are most popular, where our visitors are going, and how much time they spend there; (iii) to make usage of our Site even more rewarding as well as to study the effectiveness of our user communications, and (iv) to customize each visitor's experience and provide greater convenience.
The cookies may reflect de-identified demographic or other data linked to data you voluntarily have submitted to us, e.g., your email address. You may be able to configure your browser to accept or reject all or some cookies, or notify you when a cookie is set -- each browser is different, so check the "Help" menu of your browser to learn how to change your cookie preferences -- however, you must enable cookies from Career Key in order to use most functions on the Site.
LINKS
This Site may contain links to third party websites. Career Key is not responsible for the privacy policies and/or practices on other sites. When linking to another site, a user should read the privacy policy stated on that site. Our privacy policy only governs information collected through the Services.
ACCESSING, CORRECTING, UPDATING OR REMOVING INFORMATION
Career Key users may access, modify or remove any of the information contained in their account profile at any time by logging into their account and accessing features such as Edit Profile and Account Settings. If a user does not have that capacity because someone purchased Career Key on their behalf, they must contact the account owner to request deletion of their account. If you access Career Key through an Institutional Customer, Business Customer, or Channel Partner, see the Educational Records and FERPA Compliance section above for other limitations. Career Key users may also contact us at support@careerkey.org with any questions or requests related to personal information.
SECURITY
Career Key user accounts are secured by user-created passwords. Career Key takes precautions to ensure that account information is kept private. Career Key uses reasonable measures such as encryption to protect private information that is stored within our database against loss, theft, and misuse, as well as unauthorized access, disclosure, alteration, and destruction, and we restrict access to such private information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff. Among these measures, when you enter sensitive information (such as a credit card number) on our order forms, we encrypt the transmission of that information using secure socket layer (SSL) technology, which creates an encrypted connection between you and our systems. Once we collect your credit card or debit card information, it is stored encrypted on restricted-access computers that are not directly accessible via the Internet. Please note that no method of electronic transmission or storage is 100% secure, however, and Career Key cannot guarantee the security of user account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of member information at any time. Users are urged to also take precautions to protect their personal data by changing passwords often using a combination of letters and numbers, and using a secure web browser. SHARING AND DISCLOSURE OF INFORMATION CAREER KEY COLLECTS
Except as otherwise described in this Privacy Policy, Career Key will not disclose personal information to any third party unless it believes that disclosure is necessary: (1) to conform to legal requirements or to respond to a subpoena, search warrant or other legal process received by Career Key, whether or not a response is required by applicable law; (2) to enforce the General Terms and Conditions or to protect our rights; or (3) to protect the safety of members of the public and users of the Services. Career Key reserves the right to transfer personal information to a successor in interest that acquires rights to that information as a result of the sale of Career Key or substantially all of its assets to that successor in interest.
Career Key takes your privacy seriously. Career Key does not sell or rent your contact information to other marketers. To help us provide superior service, your personal information may be shared internally within Career Key. Career Key may share your personal information with our service providers or business partners. For example, these service providers and business partners may help us process information, deliver products to you, manage and enhance customer data, provide customer service, assess your interest in our products and services, or conduct customer research or satisfaction surveys. These companies are also obligated to protect your personal information in accordance with Career Key’s policies. Without such information being made available, we may not be able to provide the Services.
PRIVACY OF CHILDREN
This Site and our Services are oriented toward a general audience and intended for adults only. We do not knowingly collect personal information from those under the age of thirteen (13). If you believe that we have inadvertently collected personal information from a person under thirteen (13), please contact us so that we can investigate and take any necessary remedial measures. By using this Site and purchasing our Services on behalf of a person between the ages of 14 and 16, you represent to us that you are a legal guardian for that person and give consent for that person to use our Services.
This Site and Services are not directed to children under 14 years of age. When an Institution authorizes access for minors under COPPA, Career Key relies on that Institution’s consent as the child’s parent or guardian for the purposes of educational use. Career Key does not use such data for marketing or unrelated purposes.
INTERNATIONAL USERS
Career Key is a website operated from the United States by a company headquartered in the United States. If you are located outside of the United States, please note that the information you provide to us will be transferred to the United States and governed by applicable U.S. laws and regulations and this Privacy Policy. By using the site, you consent to this transfer and the processing of your data (personal or otherwise) in accordance with U.S. laws and regulations and this Privacy Policy. The applicable laws in the United States regarding the processing of data (personal or otherwise) may be less stringent than the laws in your country.
Canadian Privacy Rights
If you are located in Canada, the Personal Information Protection and Electronic Documents Act and applicable provincial privacy legislation (collectively, “Canadian Privacy Laws”) govern the collection, use, and disclosure of Personal Information by organizations in the course of commercial activities. If you are located in Canada, this Canadian Privacy Rights section applies to you. If you live in Canada and any part of our general Privacy Policy conflicts with this Canadian Privacy Rights section, this Canadian Privacy Rights section governs to the extent of the conflict.
a. Consent
Your use of the Site signifies your consent to our collection, use, and disclosure of your Personal Information as described in this Privacy Policy, as it may be amended from time to time. Your continued use of the Site after having been informed of any amendment to this Privacy Policy will be deemed a consent by you to any such amendment; if you do not agree with this Privacy Policy or any amendment, do not access the Site.
If you provide Personal Information of a third party to us, you represent that you have complied with the requirements of Canadian Privacy Laws with regards to its collection before providing it to us and for us its use and disclosure as set out in this Privacy Policy.

c. Your Rights
i. Withdrawal of Consent
Under Canadian Privacy Laws, you may withdraw your consent to our collection, use, or disclosure of your Personal Information at any time, subject to reasonable prior notice and applicable legal and contractual restrictions. Depending on the nature of the Personal Information for which you choose to withdraw your consent, if you do withdraw your consent we may not be able to provide our products and services to you; we will explain the implications of withdrawing consent to you when we receive your notice of withdrawal. If you withdraw your consent in respect of any Personal Information that has been provided to third parties, we will advise such third parties of your withdrawal to the extent required by Canadian Privacy Laws.
ii. Right to be informed
You have the right to be information about the Personal Information that we collect, use, process, disclose, and retain about you. You may request additional information regarding our Personal Information processing practices by contact us at support@careerkey.org.
iii. Right to an Accounting
You have the right to receive an accounting of the categories of third parties to whom we have disclosed your Personal Information.
iv. Rights of Access, Correction
You have the right to access the Personal Information we maintain about you and you have the right to correct or supplement your Personal Information if it is inaccurate or misleading and to have it completed if it is incomplete. Where appropriate, you have the right to have third parties to whom we have transmitted your Personal Information informed of the correction or supplemental information.
If we cannot provide you with access to your Personal Information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.
If we refuse to rectify your Personal Information, we will attach a statement to the record that sets out the reason why we have refused to make the rectification.
We will also retain the Personal Information that has been the subject of an access request or a rectification request for as long as necessary to allow you to exhaust any recourse provided by law.
v. Right to Lodge Complaints
You have the right to lodge a complaint about our collection, use or disclosure of your Personal Information with the Office of the Privacy Commissioner of Canada and any applicable provincial privacy commissioner’s office having jurisdiction.
d. Additional Rights in Quebec
If you are in the province of Quebec, you have the following additional rights:
i. Right of Deletion
Under certain circumstances, you may request the deletion of your Personal Information.
ii. Right to Data Portability
You have the right to be provided a copy of your Personal Information in a structured, commonly used, and machine-readable format, or to have it transferred directly to another entity or person.
e. Exercising Your Rights
To exercise the above rights, email us at support@careerkey.org. We will consider and process your request within a reasonable period of time and in any event within thirty days of receipt of your request or such longer time as we may be permitted under Canadian Privacy Laws. Please be aware that under certain circumstances, Canadian Privacy Laws may limit your exercise of these rights.
f. International Transfers
Your Personal Information may be transferred to and stored at a location outside of your jurisdiction of residence. Please note that local data protection laws where your Personal Information is stored or processed may not provide the same privacy protections as the data protection laws in force in your jurisdiction of residence, and Personal Information transferred to another jurisdiction may be subject to access by the courts of that jurisdiction, law enforcement authorities, and national security agencies. In cases where we need to transfer personal data outside of Canada, we will ensure that adequate safeguards, as required under applicable law, are implemented.
g. Business Transfers
Where we disclose your Personal Information in the event of a business transfer described in our Privacy Policy, we will ensure that the information is treated confidentially by the parties to the transaction and that the information will be protected by security safeguards appropriate to its sensitivity. If the transfer is completed, we will require that the parties to the transaction continue to treat your Personal Information in accordance with Canadian Privacy Laws.
h. Service providers
We may disclose your Personal Information to Service Providers as described in the above section: Sharing and Disclosure of Information Career Key Collects. Where we disclose Personal Information to Service Providers, we ensure that they are bound by contractual obligations to:
• Use Personal Information only for purposes specified in the agreement;
• Implement security measures consistent with the nature of the Personal Information processed and the processing activities; and
• Destroy Personal Information at the end of the contract or when such Personal Information is no longer required to provide the services under the agreement with the Service Provider.
i. Electronic Marketing Messages
If you are located in Canada, we will only send electronic marketing messages to you if we have your prior opt-in consent, unless an exception or a specific form of implied consent applies.
j. Information security and governance
As described in the Security section, above, we implement commercially reasonable security measures to protect your Personal Information from unauthorized access disclosure, alteration, or destruction. Such security measures include physical, technical, and administrative security controls. Each employee who uses Personal Information is bound by confidentiality obligations and has received appropriate training. In addition, each employee may only access Personal Information that is necessary for the performance of his or her duties. While we implement industry-standard security measures, no method of transmission over the Internet is entirely secure.
CHANGES IN OUR PRIVACY POLICY
From time to time Career Key may make changes to its Privacy Policy. The most recent version of the Privacy Policy will be posted on the Site, with the "Revised Date" posted at the top of the Policy. If we make any material changes to our Privacy Policy or how we handle your personal information, you will know because the Revised Date of the Privacy Policy will change. If we make a significant or material change in the way we use your personal information, we will post a more prominent notice (including, for certain services, email notification of privacy policy changes where possible) in advance of any such change for thirty (30) days where feasible. A user is bound by any changes to the Privacy Policy upon use of the Site or Services after those changes have been posted.

DISPUTES
Any disputes regarding this Privacy Policy are subject to our Terms and Conditions and will be governed by the laws of the State of Washington, applicable to agreements made and performed there.
